Agreement for Sale
Exchanges, Returns and Refunds
All returns must be in an unworn, sellable condition, and a request for a return (in the manner set out below) must be received by Kunitz Shoes by no later than 14 calendar days from the date of delivery to the address indicated. We reserve the right to refuse a return which does not comply with these rules.
Return at a location
Returns for online purchases may be completed in person at either of our Edmonton locations. Proof of purchase will be required at the time of return.
Please follow the steps below to complete an online return.
Requesting a return
To request to return an item to Kunitz Shoes, fill out the Return Request form at www.kunitzshoes.ca/returns. When the Return Request is processed by Kunitz Shoes, you will be emailed a “return authorization” number.
How to return an item
Kunitz Shoes will not accept delivery of items that do not clearly state the return authorization number on the outside of the packaging, and addressed as below:

All shipping costs for returning an item are your responsibility. Kunitz Shoes is not responsible for items lost or damaged when being returned. It is recommended that the customer keep a record of the condition of the product prior to returning it to Kunitz Shoes, as well as the tracking details of the return shipment. When the returned item is received and processed by Kunitz Shoes, and provided that you have complied with the conditions of return, you will be contacted with any details regarding the return or exchange (including the refund receipt, exchange receipt or credit notification).
Refunds, Exchanges or Credit for Returns
Refunds, exchanges or credits will be issued in the full value of the original purchase price (including applicable taxes). Any shipping costs are non-refundable.
Refunds: At the time of processing the returned item, refunds will be made in the same manner in which the item was purchased.
Exchanges: Exchanges will be treated as a separate sales transaction. At the time of processing the returned item, refunds will be made in the same manner in which the item was purchased. If you wish to try a different item, simply complete another purchase transaction.
Credit: where stipulated by the returns policy, we may offer to return an item for credit. At the time of processing the returned item, a store credit will be issued in the value of the original purchase.
Kunitz Shoes makes reasonable efforts to show products that are available for purchase and as they would be found in the store, but makes no representations that a product is available or exactly as shown. For example, our “live” inventory may not have correctly updated on the Website or a product may appear differently on the Website because of photography lighting or how your computer monitor is set up. If you require a current photograph of the product you wish to purchase, please request it from us before you proceed with completing the purchase. To the extent that you proceed with your purchase without such information, you agree that you waive any term that the product is wholly free of deficiencies.
As with any shoe store, it is likely that some of our products have been tried on, were placed on display, or are not in their original packaging. Should you wish to place a special order for a brand-new product, please contact us at email@example.com.
Different shoe manufacturers have different sizing and dimensions. To the extent that you are purchasing our products without having tried them on, you bear the risk that the product may not fit as desired. Products that do not fit may be returned, subject to the information below regarding Returns at our Returns policy at www.kunitzshoes.ca/returns.
All prices listed on kunitzshoes.ca are in Canadian dollars.
You agree to pay in full for the products, including any tax or shipping costs, prior to shipment.
Kunitz Shoes makes reasonable efforts to ensure that the prices displayed on the Website are accurate. However, prices are subject to change and without notice on the Website or may be posted incorrectly. We reserve the right to refuse or cancel any order where we deem the price to be incorrect. Please see the Cancellation section of this Terms and Conditions for more information.
All prices are in Canadian dollars and subject to additional costs such as taxes and shipping, which may vary depending on your location. We add those costs at the checkout and before you complete your purchase.
All prices are subject to taxation under the Excise Tax Act (Canada) and you agree to pay all taxes applicable arising from a purchase. In the event that the purchased product is to be shipped outside of Canada, you agree to pay any duty or other fee or charge associated with export, customs or import.
We do not offer a price matching policy and our prices may vary between the Website and in-store.
Taxes and Duties
As is required by both federal and provincial law, Kunitz Shoes will collect sales taxes where applicable. Below is a listing, by province and territory, of which taxes are collected on each purchase.
AB: 5% GST, BC: 5% GST+7%PST, MB: 5% GST and 8% PST, NB: 13% HST, NL: 13% HST, NS: 15% HST, NT: 5% GST, NU: 5% GST, ON: 13% HST, PEI: 14% HST, QC: 5% GST and 10%QST, SK: 5% GST and 5% PST, YT: 5% GST
It is the responsibility of the purchaser to pay any applicable taxes and/or duties. Currently, up to $800 in merchandise may be imported into the US free of duties and taxes.
We take reasonable measures to protect your payment information and data. Further, we use Moneris to process payments for our mutual protection. However, communication through the internet is inherently unreliable, and you accept all risks associated with such communication.
The Order Process
There are three steps in the ordering process: confirmation, fulfillment and delivery/pick-up.
Confirmation: After ordering a product, you will receive an order confirmation. This order confirmation does not mean that we have accepted your order. We must ensure that the product is available, eligible for shipping, and that your payment has been approved. If there is a problem with product availability, shipping or payment, we will attempt to contact you to find a solution, which may include recommending a suitable replacement or cancelling your order.
Fulfillment: Your order is considered fulfilled once we have confirmed that your ordered product is available, eligible for shipping, and your payment has been approved. We will then prepare your product for dispatch.
Delivery: Within a reasonable time following fulfillment, your order will be shipped in the manner requested when the product was ordered. Unless otherwise indicated, products will be shipped through Canada Post and its international partners. You agree that risk of loss passes to you when the product is delivered to the carrier (Canada Post or as otherwise specified). Where you provide instructions for the delivery service to leave the product at your door, you bear all associated risks. You agree to accept the purchased products when delivered.
Kunitz Shoes reserves the right to change the terms of delivery without notice, to use another delivery method, or where delivery is impossible or impractical, to cancel the order.
Pick Up: Where you select the “Click and Fit” service, the following rules apply, and the rules regarding Delivery, above, do not apply. Following the confirmation and fulfillment processes (including payment in full for the purchased product), you will receive notice that your selected product is ready for pick-up at one of our locations. You must bring photo identification in order to pick-up your goods, and you will have an opportunity to try on the purchased product, and deal with any required exchanges in store. Where you do not attend at one of our physical locations within 14 days from receiving notice that your purchased product is ready, the sale will be reversed and refunded, and the product will no longer be held for you.
Kunitz Shoes reserves the right to cancel any order at any time and for any reason. For example, we may cancel an order because the product is not available, the pricing is incorrect or has been changed, the product cannot be delivered, we suspect that there has been an unauthorized use of a credit card, or certain the personal details you have provided to us are invalid. Should we cancel your order, we will attempt to contact you to try to find a solution.
You may cancel an order at any time, up to the point of the product being shipped. There is no charge for cancelling an order unless we have incurred any expenses in processing your order or cancellation. We will refund your money through the same method that you used to pay us. For example, if you use your credit card to pay us, we will refund your money to that same credit card.
Unless stated otherwise, coupons are subject to the following conditions:
– They are valid for thirty days (30) only;
– They cannot be combined with any other coupon, promotion or discount;
– They are limited to certain brands, items or quantities; and
– They cannot be redeemed for cash.
We reserve the right to place additional conditions on the use of coupons.
We are currently unable to process or sell Kunitz Shoes gift cards through our website. If you have a gift card that you would like to use to make a purchase on kunitzshoes.ca, please contact us at firstname.lastname@example.org.
Credit vouchers for kunitzshoes.ca
Credits issued through kunitzshoes.ca do not expire. They are valid for products listed on the website only and may not be redeemed for cash. While intended to be used on kunitzshoes.ca, a credit voucher can also be used in our stores by completing a purchase though the website on site.
Except as set out in these Terms and Conditions, and to the extent permitted by applicable laws, Kunitz disclaims any warranty in relation to the purchased product, including implied warranties of merchantability, fitness for a particular purpose or title. Kunitz Shoes shall not be liable to you in relation to any damage arising from the use of this Website.
Inspection, Defects and Manufacturing Defects
You agree that you will inspect the purchased product when it arrives at the delivery point specified in the order, and to promptly advise us of any concerns with the product.
Where you believe that there is a problem with the product ordered, such as a defect caused during shipping, your sole remedy is for Kunitz Shoes to repair or replace any defect of damage cause by Kunitz Shoes or by the delivery service (except where the delivery service is chosen by you). Kunitz Shoes reserves the right to cancel the order in the event that it is unable to replace or repair the product.
Kunitz Shoes guarantees all product against manufacturing defect for 6 months from the purchase date.
A “manufacturing defect” is defined as a failure in either materials or craftsmanship that may result in a product not performing in its intended capacity.
If a product has suffered a manufacturing defect within 6 months of purchase Kunitz shoes will either repair, replace, or offer a credit for the product as best suits the case. Kunitz Shoes does not guarantee its products for wear-and-tear.
Repair: Where possible, Kunitz shoes will endeavour to repair defective footwear. If it is possible to repair a defective product, Kunitz Shoes will undertake to do so in either its own workshop or send out the defective product for repair if needed. If the product is covered under the guarantee, Kunitz Shoes will cover all costs of repairs. However, you agree to pay for the costs of shipping the products to us for repair, and for the subsequent cost of shipping the repaired product to you.
Replace: If the defective product is not repairable, or the defect is too severe to warrant repair, Kunitz Shoes may opt to replace the defective product. If the product is covered under the guarantee, Kunitz Shoes will cover all costs of replacement. However, you agree to pay for the costs of shipping the defective product to Kunitz Shoes, and for the subsequent cost of shipping the replacement product to you.
Credit: If it is not possible to repair a defective product and it is not available to replace, Kunitz Shoes will credit the original purchase price of the product to you.
Any disputes between Kunitz and you arising from or relating to a purchase must be dealt with through binding arbitration in accordance with the Arbitration Act (Alberta), with such arbitration to take place in Edmonton, Alberta. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The laws of Alberta and Canada apply to this agreement for sale, without reference to conflict of laws principles.
Purchasers in Quebec
The parties declare that they have required that these terms be drawn up in English only. Les parties déclarent qu’ils exigent que cette entente soient rédigés en anglaise seulement.
